Sculptme Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the SculptMe website at [www.sculptmetx.com] and any services, classes, memberships, bookings or related features offered by SculptMe (“we,” “us,” “our”). By accessing this website or using any services, you agree to these Terms. If you do not agree with these Terms, you must not use this website or purchase/use any services.

1. Acceptance of Terms

By accessing or using the SculptMe website (the “Site”), booking classes, purchasing memberships, or otherwise interacting with our services, you agree to be bound by these Terms and our Privacy Policy. Your use of the Site or services constitutes your acceptance of all Terms. 

2. Changes to the Terms

We may update or revise these Terms at any time. Changes take effect when the updated Terms are posted online. Continued use of the Site or services after changes signifies your acceptance.

3. Use of Site

You agree:

  • To use the Site only for lawful purposes.

  • That you are at least 18 years old.

  • Not to post or transmit anything unlawful, harmful, defamatory, offensive, or that infringes rights of others. 

Any violation can result in suspension or termination of your access.

4. Memberships, Classes & Billing

When you purchase a membership or book classes through the Site, you agree to our terms regarding:

Payments

  • Payments will be processed via the billing method you provide.

  • All fees are due in advance and are non-refundable except as stated in our membership agreement.

Bookings

  • You must book classes in advance using our Site or app.

  • Late cancellations or no-shows may incur fees as published separately in our studio policies.

Membership Terms

  • Membership billing renews automatically unless cancelled in writing per the Cancellation Terms in your Membership Agreement.

  • Freeze or suspension requests must be submitted in writing and are subject to our freeze policy.

5. Health & Risk Acknowledgement

By using our services (online or in-studio), you acknowledge:

  • Pilates and other fitness activities involve physical risk, including injury or health issues.

  • You are responsible for consulting a physician before participating if you have concerns.

  • You agree not to hold SculptMe liable for injuries or losses except where prohibited by law.

This acknowledgement supplements but does not replace any waiver you sign in-studio. 

6. Privacy & Personal Data

Your access to and use of the Site and services is also governed by our Privacy Policy, which explains how we collect and use your personal information. By using the Site, you consent to these practices. 

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, video, software and design — is owned by SculptMe or its licensors and is protected by copyright and trademark laws. 

You may only use content as permitted, and you may not reproduce, modify, or distribute any content without express written permission.

8. Prohibited Conduct

You agree not to:

  • Use the Site to engage in fraudulent, abusive or harmful conduct.

  • Interfere with another user’s enjoyment or access.

  • Harvest or collect personal data from the Site without consent.

9. Termination

We may restrict, suspend or terminate your access to the Site or services at our discretion — with or without notice — if you violate these Terms or for any reason that we deem appropriate. 

10. Disclaimers

The Site and all services are provided on an “as available, as is” basis. SculptMe disclaims all warranties — express or implied — including, but not limited to, warranties of accuracy, fitness for a particular purpose, or non-infringement. 

11. Limitation of Liability

To the fullest extent permitted under applicable law, SculptMe and its owners, employees, agents, affiliates and representatives will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or services.

12. Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of laws principles. Any legal actions will be brought in the appropriate courts of Texas.
